The Rules of Engagement
1. The Relationship
SmartBirb is a Web Operations Consultancy, not a commodity hosting provider. By chartering us, you are hiring a dedicated professional to manage your digital infrastructure.
While we procure and manage high-performance servers on your behalf (via WP.cloud), we do not own the data centers. We act as your skilled pilot; the plane is provided by our enterprise partners.
2. The "Company of One" Cap
We strictly limit our client roster to a deliberately small roster. That is, we accept only a handful of founding clients - serious operators who want a captain, not a vendor. This ensures availability. However, it also means we reserve the right to decline service or terminate a charter (with a graceful handover) if the relationship interferes with our ability to serve other clients effectively.
3. Scope of Authority
To guarantee the safety of your vessel (website), you grant SmartBirb the authority to:
- Update plugins or themes immediately if a security vulnerability is detected.
- Block malicious IP addresses or traffic patterns.
- Deactivate plugins that cause severe performance degradation or instability.
We will always inform you of these actions, but the safety of the ship comes first.
4. Limitation of Liability
We safeguard your site with enterprise-grade tools, daily backups, and constant vigilance. However, the internet is a hostile ocean. SmartBirb cannot be held liable for:
- Downtime caused by upstream provider outages (e.g., WP.cloud, Cloudflare or AWS failures).
- Loss of revenue due to third-party plugin bugs.
- Acts of God or global network interruptions.
5. The "No Hostage" Clause
You own your data. Always. If you choose to leave SmartBirb, we will personally assist in packaging your site, database, and files for migration to a new provider. We do not lock doors.
